State of New Hampshire v. Hess Corporation, et al.

(New Hampshire Superior Court, Merrimack County) Represent the State of New Hampshire in a lawsuit against over two dozen petroleum companies arising from MTBE-contamination of groundwater. Reached settlements providing over $130 million to the State for clean-up. After three-month jury trial against the non-settling defendant ExxonMobil, jury found that the State’s damages totaled over $816 million and found ExxonMobil responsible for over $236 million of that amount. The New Hampshire Supreme Court affirmed the jury verdict, and the United States Supreme Court denied ExxonMobil’s petiton for review.
