The fall issue of the California Nevada AWWA Source Magazine contains an article on the TCP contamination litigation process. SL Environmental Law Group. SL pioneered the products liability litigation theory against groundwater polluters. SL first applied this theory in 2004 when it filed suit on behalf of the Hawaii Water Service Co. against the manufacturers and distributors of pesticide products containing TCP to recover the treatment costs associated with the contamination of its drinking water supply. That case was settled before it went to court. The environmental law firm took that model to California and filed the first TCP lawsuit in this State on behalf of the City of Oceanside, California.
