Water Systems as Plaintiffs

Most water systems—like most organizations of any kind—would prefer to stay away from lawsuits altogether. The brilliant judge Learned Hand (who saw a few lawsuits in his day) once said that he “should dread a lawsuit beyond almost anything short of sickness and death.” But this fear of litigation, however rational or understandable, may deprive water systems of the opportunity to shift their costs of treating manmade contaminants to those parties whose defective products or irresponsible corporate practices result in contamination of groundwater or surface water supplies.
